Pursuant to subsection 5.9(2) of the Aeronautics Act, and after having taken into account that the exemption is both in the public interest and is not likely to affect aviation safety, I hereby exempt Aviation Starlink Inc., 9025 Ryan Avenue, Dorval, Quebec, H9P 1A2 from the requirements set out in clause 725.07(2)(a)(i)(A) of the Commercial Air Service Standards (CASS) made pursuant to subparagraph 705.07(2)(b)(i) of the Canadian Aviation Regulations (CARs), subject to the following condition.
Subparagraph 705.07(2)(b)(i) of the CARs requires that air operators employ operations managers who have been approved by the Minister in accordance with the CASS.
Clause 725.07(2)(a)(i)(A) of the CASS states that the operations manager must hold or have held the appropriate licence and ratings for which a pilot-in-command is required to hold for one of the aeroplanes operated.
PURPOSE
The purpose of this exemption is to allow the air operator, Aviation Starlink Inc., which operates under subparts 5, 4, and 3 of Part VII of the CARs, to employ an operations manager who does not have a type rating for the Embraer 120, the only aircraft operated by the air operator in accordance with subpart 5 of Part VII of the CARs.
This exemption will allow the operations manager to receive full training on this type of aircraft, i.e. the Embraer 120, and thus be rated on this type of aircraft as required by the CASS.
APPLICATION
This exemption applies only to Mr. James R. MacDonald, licence number AA-233955, in order for him to act as an operations manager.
CONDITION
This exemption is subject to the following condition:
- The aircraft type Embraer 120, registered C-GOAD, must only be operated with the company’s chief pilot, Dominique Santerre, licence number AA-333988, as the pilot-in-command.
VALIDITY
This exemption is valid until the earliest of the following:
- September 1, 2007 at 23:59 EDT;
- the date on which the condition specified in the exemption is breached;
- the date on which Mr. James R. MacDonald is rated on the aircraft type Embraer 120;
- the date on which this exemption is cancelled in writing by the Minister where he is of the opinion it is no longer in the public interest, or is likely to adversely affect aviation safety.
